Nintendo Switch 2: First-Party V. Third-Party Games—A Battle of Pricing and Strategy



As you know, the Switch 2, is on the way! The excitement is palpable. But beyond the flashy next-gen hardware upgrades and features, there’s a different conversation brewing—game pricing. With Mario Kart World launching at a whopping $79.99, we have to ask: Will third-party developers win big on Nintendo’s own system?

For a long time, Nintendo’s first-party games have been the main draw of their consoles. If you wanted the latest Zelda, Smash Bros., or Mario Kart, you knew the price would stay firm—sometimes forever. Unlike other publishers, Nintendo is famous for keeping their games at full price for years, rarely offering discounts. But now, with a potential $20 price gap between Nintendo’s biggest games and major third-party titles, the playing field might be changing.

Think about it—if you’re an average gamer balancing bills, rent, and life’s expenses, that extra $10 to $20 per game matters. A lot. Some players will still shell out for Nintendo’s exclusives, no question. But for others, that price gap might make third-party titles the go-to option. And developers likely know this. If studios like Capcom, Ubisoft, and Square Enix set their prices strategically, they could grab a bigger slice of the market.

Nintendo wouldn't be able to ignore such a thing. Either they’d need to offer more competitive pricing, or find some other way to keep gamers from flocking to third-party alternatives for the most part. Because at the end of the day, money talks. Not everyone can casually spend $80 per game, and if the Switch 2 becomes a third-party haven simply due to affordability, Nintendo might have to rethink its pricing strategy. One things for certain, that would be a win for gamers!

Nintendo Switch 2: Bricked Edition?! Yes... if you FAFO! But...

Are gamers prepared for what lies ahead with the Nintendo Switch 2? If you haven’t heard about the potential pitfalls surrounding Nintendo’s latest console, buckle up—because the fine print of its user agreement might be a wake-up call. 

The License Agreement – A Ticking Time Bomb?

At first glance, Nintendo’s user agreement appears standard, granting players a non-exclusive, non-transferable, revocable license to use Nintendo Account Services for personal gaming. However, a deeper dive reveals strict limitations. Gamers are prohibited from modifying, reverse-engineering, decrypting, or tampering with any part of the system. While this is expected, one clause raises eyebrows:

> If you fail to comply with these restrictions, Nintendo may render the applicable device permanently unusable—either in part or entirely.

Translation? If Nintendo believes a device was tampered with, it reserves the right to brick the console remotely. This could spell disaster if a false flag occurs or an unforeseen glitch leads to unwarranted punishment.


The Arbitration Clause – No Class Action

If a player's system gets bricked by mistake, don’t expect a class-action lawsuit to hold Nintendo accountable. Section 16 of the agreement contains binding arbitration provisions, meaning disputes must be settled individually. Even if an entire wave of consoles malfunctions due to an error, players would be forced to fight their case alone—a daunting and costly challenge.

Gamers shouldn’t forget that Xbox once miscalculated with the Xbox One, attempting to enforce always-online DRM policies before reversing course due to backlash. Nintendo would do well to ensure safeguards are in place, protecting users from unjust penalties rather than assuming guilt by default.

Should Modders Be Concerned?

If you enjoy modding and customizing your gaming hardware, putting a Nintendo Switch 2 on the line may not be wise. With an agreement that grants Nintendo full authority over system usability, choosing a mod-friendly alternative like the Steam Deck might be the smarter move.

As gaming evolves, players should always be aware of what’s written between the lines. Is the Nintendo Switch 2 a game-changing device, or could it be a potential risk for consumers? Time will tell—but informed gamers should always tread carefully.
